A recent national study by DiscoverCars.com placed Texas as the #3 state for first-time drunk driving offenses, and that should make every Texan pause. We pride ourselves on being friendly. Respectful. Neighborly. So how did we land so high on a list like that?

What Counts as “Drunk” in Texas?
In Texas, the legal blood alcohol concentration (BAC) limit for most drivers is 0.08%.
But here’s what many people don’t realize:
Even if your BAC is below 0.08%, you can still be arrested if an officer believes your ability to drive is impaired.
That’s the part that gets overlooked.
Alcohol affects everyone differently, based on body size, metabolism, and even whether you’ve eaten. For some people, just a few drinks can push them past the legal threshold. In lower-limit states like Utah, the cap is 0.05%. And in many places worldwide, even less.
The safest number? Zero.
The Real Cost of a First-Time DWI in Texas
According to the study, a first-time DWI conviction in Texas can bring:
- Fines up to $2,000
- Up to 180 days in jail
- License suspension
- And if your BAC is 0.15% or higher, fines can reach $4,000 with possible jail time up to one year
And that doesn’t include:

- Mandatory education programs
- Increased insurance premiums
- Long-term financial consequences
But there’s something even heavier than fines.
Texas’ 2022 Law Every Driver Should Know
In 2022, Texas passed a law requiring drunk drivers who cause a fatal crash involving a parent to pay child support until that child turns 18.

If someone makes the choice to drive impaired and it costs a child their mother or father, they can be legally required to financially support that child for years to come, including potential educational expenses.
